Beth Modica Former DA Faces Teen Sex Charges

Beth Modica is a former Rockland County, New York Assistant District Attorney. She has pleaded not guilty to charges that she had sexual intercourse and oral sex with two teenage boys. She is also charged with supplying the minors with alcohol and marijuana and using the substances along with them.

The 44 year old woman has been charged with 35 counts which include 5 felony charges: one count of third degree rape, four counts of third degree criminal sexual assault. She has also been charged with 30 misdemeanor counts; four third degree sexual abuse and 26 counts of endangering the welfare of a child.

She is the estranged wife of Spring Valley police Chief Paul Modica. He claims to have no knowledge of her activities with underage boys between July 1st and September 1st, 2007. The encounters were with a 16 year old boy and a 15 year old boy, members of her son’s hockey team and school mates.

Beth Modica is currently an assistant city attorney in Ramapo and village attorney in Sloatsburg, where she lived with her husband and children prior to charges being filed.

Part of the investigation dug into whether her husband, the police chief, knew anything about the situation. It appears he was not aware of anything remiss in her relationship with boy’s from her son’s hockey team. The investigation ruled any further involvement by other hockey team members.

The investigation began on December 31, 2007 after a complaint came to light through a letter sent to the Ramapo police department.

Bail for Beth Modica has been set at $75,000. She is currently in good standing with the New York Bar Association. It is unclear what steps may be taken to remove her license to practice law in the state.
